There is nothing illegal with this. Hopefully officer will not show at trial. Get an attorney to deal with this.

You violated probation as you did not complete program and your three years is not up. The judge can sentence you to the maximum of the the charge....

You might have a chance to knock out the probable cause for your stop- but the officer's observations will be difficult to overcome.
