Took my money and did not see or hear from him again for 7 months.

By that time, the judge was calling his name at my court hearing which he was not initially there for. When he did show up later in the afternoon, he was reprimanded by the judge for being late and the incomplete and sad state of the paperwork that had been filed. I lost my temper with his office af...ter countless failed attempts to get anything done on my case. He then filed paperwork to have himself removed from my case and said I was unreasonable. I have a simple uncontested divorce with no real property to divide and my husband didnt even respond to the paperwork. Coming up on a year and his office said they would prepare the document for my husband and I to sign and I wouldnt have to pay the $2000 I still owed him. That was a reasonable resolution. I waited for weeks for the document to sign. Promised over and over again. Last minute, he wont give me the document until I pay $2000. Now he is holding my case hostage. I am on disability. In the last year, I have been hemorrhaging money which could have gone to pay Mr. Ojeda had he done something. I will update my review if anything changes. As of now, Mr. Ojeda still takes people's money and fails to represent them, return calls, emails, text messages or even answer a question through his paralegal. He will have to answer once again to the State Bar.

Tricia thank you for your review. My position is you signed a retainer for my services a flat fee and agreed to pay a certain amount. Other than your initial retainer and subsequent assertion you have no money I told you I did not agree to continue with your case and sent you the form to sign which you refused. I therefore had to file a motion with the court to obtain permission to no longer be your attorney. I am not holding your file hostage in fact you never asked for it. Also my work was fine Judge was fine and you received a spousal support order plus health care orders you requested. As I recall about 1900 a month. In addition I saved you court fees by obtaining a fee waiver. Costs saved were 435 and 90 respectively. You have a right to review me but I believe you've left out important information like the fee waiver, I prepared your dissolution, financial documents and request for order plus attended the hearing wherein support was ordered. I am a sole practitioner and cannot work for free (I have overheard like rent phone secretary advertising) thats why there are contracts entered into and why clients pay on time. You are the client who breached our contract. You decided not to pay as agreed. Any consequences are not due to my conduct but in fact yours. I wish you had been honest about your inability to pay. Had you been upfront with me before I took on your case no one would have wasted their time. Best of luck to you.

An Attorney You Can Work With

I have been utilizing Mr. Ojeda's services since 2014 for both my custody and child support cases. I recently finalized a complicated child support case that had been severely affecting my living expenses for years due to the huge garnishment. It took a lot of patience, time, and caused a great deal ...of anxiety. I felt like the other parent was living a luxurious lifestyle with my money that I worked hard for, including my overtime. Mr. Ojeda was able to reduce all of my child support, including the back support to a total $0.00!!! He did this all during this pandemic and with me not having to show up to his office for the court hearing call. I understand Mr. Ojeda takes on a lot of cases which can sometimes make it difficult to get a quick response from him. At the same time, he will get back to you and give you his full attention as your case gets closer to the hearing date. Overall, based on my experience working with Mr. Ojeda for over 6 years, he is professional, polite, and always thinks about the bigger picture in every scenario. He is not the type of attorney that will be aggressive asking for a huge retainer or consultation fee but instead, will try to work within your budget. Many thanks for your support and service - we'll definitely be in touch again soon!

Divorce

Let’s start off with this ridiculous star system. This attorney does not deserve a single star. He is the worst, unprofessional attorney on the face of this earth. I wasted my time and money on this person. Not only was it a waste of time and money but he made things even more difficult for me in cou...rt because he wasn’t able to file the documents correctly on my behalf. I probably could’ve represented myself a lot better than what he did for me. He would schedule me to be in court and never show up. He setup a meeting at his office and wouldn’t even bother to tell he that he wasn’t showing up. The way he expressed himself about my ex husband was uncalled for. I mean, I hate my ex but why did MR. OJEDA? When I asked for an explanation about why he never showed up to our meetings he ended up mad at me instead of apologizing for he did. He said “ if you think I’m unprofessional then find someone else” So that’s exactly what I did. My Biggest mistake was not checking for reviews about his services. If I would’ve checked to see that his license was Suspended in 2010 I wouldn’t have hired him.

since you don’t give a name it’s hard to address your comments. i’m happy to discuss with you off line if you’d like. or provide your name and i will post the transcript of the hearing. if it’s a bad as you say the transcript will show it. when you give no information it doesn’t allow for me to defend myself and maybe that was what you intended. thank you.

Overloaded and not always reliable

Bernal does a fairly decent job in court but because of his cheaper retainers, he TENDS to cut a lot of corners with paperwork. He is also often hard to reach and sometimes unprofessional/borderline rude in his communications. I had to let him go after he decided to change his fees on me just days be...fore a key hearing. I am glad I did. The new lawyer was top notch, though a bit more expensive. You get what you pay for.

Thank you I appreciate the feed back. i can’t address your situation since you don’t give much information. I believe we had an issue about your veracity regarding your income and a construction business. Anytime a modification of support is requested a party must be clear on all sources of income. I got the impression you were being evasive and not fully honest. Plus for someone saying they make very little you paid 80,000 plus for your custody dispute during the same time you claimed you had no money. I told you more than once Judge won’t believe you and yes you hired someone else but the result was the same. Your request to reduce child support was denied now for the 3rd or 4th time.

"I wholeheartedly endorse Mr. Ojeda. I have known him for 35 years, and have frequently both associated with him on cases as well as sought his professional opinion on family law matters. His wisdom and practical advice have been invaluable on many occasions! We family lawyers treasure those whose opinion we can trust. No one can know it all, and when I don't, I approach Mr. Ojeda who is not only patient but incisive.... "cutting to the chase" and getting to the heart of a matter and how to approach it. I highly recommend his legal services and have found his character and ethics, as well, to be outstanding."

Professional misconduct

This lawyer was disciplined by a state licensing authority in 2010.

Discipline with Actual Suspension issued in CA, 2010

updated on 01/20/2016

This sanction means the attorney lost his or her license to practice law for a period of time. The attorney typically returns to practicing law when the suspension expires.

Bernal’s comment:

“This resulted from staff who were under my supervision. Since it was my office I paid the price although cases were handled buy other attorneys and staff. Affected clients received refunds or got their bankruptcy done. Bar was not willing to put that in the stipulation. Also these things occurred in 2006. Took 4 years to reach a settlement. 11 years have passed since then and I've been i good standing.”

Public reproval with/duties issued in CA, 1997

updated on 03/05/2015

A censure or reprimand issued by the Supreme Court or the State Bar Court that is not a matter of public record unless imposed after the initiation of formal disciplinary proceedings. No period of suspension is imposed. The reproval may be imposed with duties or conditions.

Bernal’s comment:

“No client was harmed. Had to do with paying office rent using my trust account that held my attorney fees I had earned. Happened in 1995. 20 years ago but not resolved until 1997.”
