No, you're cheating by applying rent yourself and trying to reclassify the late fee as rent. If the judge gets wind of it, you'll lose the case. ...

It's not a valid threat. He can whine to the police, but only the District Attorneys (or City Attorneys where delegated) can file criminal charges.
