I had never been accused of a criminal matter for the first fifty plus years of my life. Recently, I found myself in the unfortunate situation of being prosecuted by an over-zealous District Attorney for the very first misdemeanor charge ever leveled against me. The DA's negotiation was not about w...hether I was going to jail or not, but how many months they were willing to settle the case for in Country Jail in a plea bargain. They made a Serna Motion based upon the DA's violation of my constitutionally guaranteed right to a speedy trial. The Motion was successful and resulted in dismissal of the case.
