True. If convicted, however, it will never "come off your record." CA doesn't have real expungement. So, you need a lawyer to stop the conviction...

You don't have to actually be found inside the car to be charged. Hire a lawyer.

They only need to read you your rights if you are in custody and they are interrogating you. If not, they don't need to.

He needs a lawyer, now. Once filed, it is rare for charges to be fully dismissed. It may be possible, but he needs a lawyer working on it ASAP.
