If he is in fact a "step-son" then your husband should be able to petition him irrespective of an adoption. Consult with an immigration attorney...

You could file both petitions at the same time. Note that your parents cannot petition your married brother until they become US Citizens.

He needs to retain a criminal defense attorney immediately. He most likely will have an ICE hold on him, so he will need an immigration attorney...
