No. Anyone can benefit from Section 245(i) if they meet the requirements.

Generally, yes. You are out of nonimmigrant status dating back to the date yoru I-94 expired.

If your attorney cannot figure out the one-page I-765 form, you may want to consider hiring someone else.

You must have been residing in the US for at least half of the total 5 years proceeding your application AND cannot have absences in excess of 180...
