Complainant, a Service Representative at the Agency’s Kapolei, Hawaii office, filed her complaint alleging discrimination based on disability and in reprisal for prior EEO activity when: her October 22 ... and 30, 2008 requests for accommodation were not granted; and she was subjected to harassment from September 28, 2008, forward. The hearing was held on May 29 and 30, and June 11, 2012. The AJ found that the Agency discriminated against Complainant based on her disability when she was denied her requests for accommodation for a parking space and not to perform eServices duties. The AJ awarded Complainant nonpecuniary compensatory damages; attorney’s fees and costs, and 33% of the leave she used during the period from October 21, 2008 through July 1, 2009. The The Agency, appealed the the AJ’s finding of discrimination based on disability when it denied Complainant’s request for accommodation and the concomitant remedies. The Agency sent it appeal to an incorrect address for the Office of Federal Operations on November 9, 2012. The Commission found the Agency submitted no evidence and the record was devoid of any evidence that the Agency filed its appeal to the proper address at the Commission within the 40-day time limit. The Commission noted the Agency did not submit any adequate justification to invoke waiver or equitable tolling for filing the appeal.
