The answer to both of your questions is "yes". One can be illegal in the U.S. without accruing "unlawful presence". The latter is a term of art.

It depends on how long ago your I-94 expired. If this occurred less than 180 days ago, you shoudl leave the U.S. and re-enter with a new valid I-94.

The petty offense exception is really the "one petty offense" exception. Since you have two criminal convinctions, this does not apply to you.
