USCIS denied our client's N-400 application claiming that she was not "lawfully admitted" for permanent residence. This claim was based on the theory that her California marriage to a US citizen (a ba ... sis of her permanent residence) was void from the beginning because the husband's Nevada divorces from his prior spouses were invalid for not having personal jurisdiction (i.e., having living there). Mr. Sekiya successfully argued 1) the defects in personal jurisdiction only makes the Nevada divorces voidable, not void, and a third party (like USCIS) could not legally challenge the final divorce judgment in Nevada; and 2) according to the U.S. Supreme Court precedents, the jointly-obtained Nevada divorces are entitled to full faith and credit (legally recognized) in California despite the jurisdictional defect. The client became a U.S. citizen shortly after the decision.

Client's VAWA-based I-485 adjustment application (along with I-601 waiver application) was denied for coming to the US with a fake name. We are able to reopen the case and have it approved by presenti ... ng, among others, the evidence of "extreme hardship" to the applicant.
