My client was charged with battery on a pregnant woman and 2 counts of cruelty to a child arising from a neighbor dispute. Turns out she wasn't pregnant at all (this came out on the stand when she gave ... 3 versions of the events) and her "child" was never touched by my client, but in fact, summoned a gang to come after my client and throw rocks. My client, who speaks no English didn't call the police so he was arrested once they arrived. This time they really did have the wrong guy! I hired a fingerprint analyst and a DNA specialist who found not a trace of DNA from my client that linked him to the gun he was charged with possessing. ... He was on parole which means he had a "hold" and was in custody for 9 months. His first 2 public defenders let him sit there and rot. I got a hold of the case and took the bull by the horns. He was deprived of his liberty for 9 months but at the end of the trial, he was set free and is now doing well. This was a battery case that arose from a neighbor dispute. After careful review of the files I was able to ascertain that there had been some sloppy police work and that a deputy had come to the scen ... e and told her not to press charges because it was "mutual combat" and that if she did, they would both go to jail. She was arrested 20 days later and taken into custody when she found me. I got her released OR and we fought the case all the way to the day of trial. We had witnesses on our side including one of the deputies who was not listed in the report! Case dismissed on last day per 1382!
