This was a client with a gun charge. I got the City Attorney to resolve it through an informal administrative hearing and the case never got filed! This would have impeded his ability to work and pos...sibly been filed as a felony. This is better than a dismissal because the case never got filed due to resolution!

OUTCOME: People unable to proceed
My client was charged with approximately 15 counts of forgery and counterfeiting. This case arose from passing counterfeit 100 dollar bills and was from 2003. He was granted immunity by the FBI to tur...n state's evidence against another co-defendant, however, in 2006, the People filed against him. I filed a Serna motion based on prejudice to my client due to the staleness of the case and lack of due process. Furthermore, the notice to appear was sent to him ONE YEAR AFTER the appearance date, and mailed to his mother's address, even though the arresting agency had his current home address through the DMV. Needless to say, after strenuos argument with the court, I had the warrant recalled and quashed. My client was facing a year in the County Jail and restitution of $5,000.00, however, the Serna motion was granted and the People announced they were "unable to proceed" with prosecuting Mr. Alcanter. OUTCOME: Dismissed by the People on day of jury trial
This was a domestic violence case that evolved when a couple got into an argument on Christmas night. The alleged victim, who was confused and upset after an argument with my client, wound up walking ...in the middle of the street, unaware of the danger of buzzed drivers and heavy traffic. The boyfriend (my client) pulled her to safety, but a passing motorist thought the woman was being kidnapped. Several other motorists got involved and called 911. My client was arrested on Christmas night and taken into custody even though the "victim" told the cops he never struck her or touched her in any offensive manner. It turned out two of the callers were on probation, one for petty theft, the other a felon. This was uncovered after extensive investigation into the state's witnesses backgrounds and analysis of the 911 tape. The matter was dismissed on the merits per 1385 on the day we were to start trial. Needless to say, the client is over the moon and extremely grateful for all of my hard work. OUTCOME: Dismissal in furtherance of justice
My client was charged with grand theft auto, a trumped up charge filed by the "victim's" family. I got the People to see that this was contrived because the police were not called until three days aft...er the alleged incident and that it was in retaliation for my client hitting another car while driving his friend's parent's car. OUTCOME: Charges dropped for insufficiency of the evidence!
This was a second degree burglary case. My client was accused of breaking into a neighbor's car. It was a mistaken identity case because that day he had been hanging out with another person dressed e...xactly like him. There was reasonable doubt because this other person's cell phone was found in the car that was broken into. My client is applying to become a police officer and a conviction against him would have prevented him from obtaining his goal because it was a serious misdemeanor. Once I pointed out to the People the weaknesses of their case, they dismissed for insufficiency of the evidence. However, this wasn't until we were almost ready to pick a jury and I announced ready. OUTCOME: Not guilty after 7 day jury trial
My client was a well liked bouncer in a club who was simply doing his job. When he asked several patrons to leave, a malee broke out between three of the patrons and my client was blamed. At the end ...of the day, the jury was able to see that this "patron" was just trying to shake down the bar/restaurant for money and that my client was factually and legally innocent of the battery charges. My client was charged with domestic violence. It was a very emotional time for her as she was moving out of her husband's house. He became upset and called the police during an argument. Basically, ...he called 911 first. After vigorous investigation I was able to get to the bottom of it. The DA pressured us to settle before trial but we stood firm, the result was success!
