Chapter-7 converted into Chapter-13

There are not enough words to explain the mental stress I endured for 6 months after filing a Chapter-7 BK by a nonprofessional petitioner. My nightmare started after i received Court documents from the BK Trustees threatening to sale my home in lieu of me filing a Chp-7 erroneously by my petitioner.... I immediately start looking for an Attorney to represent my case, my nightmare lifted when I found Michael Jay Berger Bankruptcy Law Firm of Beverly Hills. Certified Genius - and then some.

In life, we don't know what is around the corner. With all good intentions, and best efforts, we all fall short sometimes through some set of circumstances that we have no control over. Some people call this fate, but I like to think of it as simply the nature of living. We can not avoid calamity, or... illness, and we can not control our destinies even if we feel that we control our daily life. In such circumstances as could befall anyone, my wife and I found ourselves with a failed business which we could blame on economic conditions and a crummy adjustable rate mortgage which suddenly soared beyond our ability to pay. Our real estate holdings consisted of a home on Long Island that was valued at around 450,000 dollars, and a nice lofted condominium in Santa Monica, which was marketable at around 750,000, at the time. We had an Art Gallery in Los Angeles and had some great shows with a high turnout, but very low sales. We had clients who were top of the line artists, and nobody can deny that we worked hard and produced enormous volumes of work, but our Gallery was still not successful and it became evident one day that we needed to divest ourselves of the Gallery and to go our separate ways with our business partner. As unhappy a story as that may be, we buckled down and tried to make it work and with two kids, and supporting our in-laws at that time as well, our corners became very rounded and we abruptly found ourselves sinking into serious debt as our tenants in our NY house moved out unexpectedly, leaving the house in a deteriorated state that made it un-saleable and un-rentable. They had drilled holes in the roof to mount a dish antenna, and did not fill the holes with waterproof silicone, and apparently had moved the dish for reception reasons to several positions on the roof, leaving multiple sets of holes. Heavy rains caused damage to the ceilings and carpets and went through the house like a flood, because the roof where they were drilling was flat, not sloped and the water pooled and caused enormous damage. Meanwhile, we did not know of this until our real estate agent informed us one day of the problem, and I drove to NY from California to check out the condition of the house and it was a wreck. They had painted one of the upstairs rooms black on 1 and a half of the walls, without ever completing the job. The rugs were all damp and lifting off the floors from water damage, and stains on the ceiling were dark brown for half of the master bedroom. I had painted every room of that house freshly before renting it, and had rebuilt and re tiled both bathrooms and installed all new fixtures and plumbing, and electrical, plus had completely redone the kitchen with all new appliances, re tiled the kitchen, and, built a beautiful marble peninsula counter that could seat 6 people. On top of that to meet rental regulations I had installed all new baseboards throughout the house and installed extra railings and walled the stairwell. After getting estimates of over 10,000 dollars to repair the roof, without even considering that all carpeting needed replacement and 2 ceilings needed major gutting and replacement, I was informed by my neighbor that a truck was seen driving away from my home with half of my copper piping and fixtures hanging out of the back as someone had broken into the house and stolen various hardware and piping, which, even though the water was turned off, now was going to mean more expense to handle that problem. Needless to say, when our ARM kicked in and added about 4000 dollars per month in additional (adjusted) cost to our 2 mortgages combined, and without sufficient income to pay that, we had to turn to someone for professional help. That person turned out to be Michael Jay Berger. I was originally impressed by his web site which included a comment that he was a certified "genius". Well, I could not agree more. We had approached another attorney with our problem prior to interviewing with him, and that attorney did not promise or deliver anything and basically told us that the laws were
