Mr. Roman Otkupman is the founding attorney of Otkupman Law Firm, A Law Corporation. Mr. Otkupman commenced his legal career by securing an externship at Equal Employment Opportunity Commission where he was a Judicial Extern for the Supervisory Judge, Larry A. Abrams. There, he evaluated the merits of federal employment discrimination claims, including Title VII and Title II discrimination cases. He also recommended dispositions of cases, and researched and drafted bench decisions. Mr. Otkupman also reviewed motions, researched relevant case law, prepared summaries of legal arguments and assisted in preparation of court rulings. He further attended pre-trial conferences, settlement conferences, hearings and numerous trials. During law school, Mr. Otkupman also worked at the San Diego Employee Rights Center where he dealt with numerous issues pertaining to employment discrimination and provided legal advice to employees alleging wrongful termination.
Upon graduating law school, Mr. Otkupman worked for a Plaintiff’s Employment Firm where he gained experience litigating cases pertaining to Age Discrimination, Disability Discrimination, Gender Discrimination, Race Discrimination and Whistleblower claims, as well as drafting appeals.
Mr. Otkupman then joined a Beverly Hills Employment Defense firm where he defended Age Discrimination, Disability Discrimination, Sexual Harassment, Labor Code 132(a) claims, Whistleblower claims, Gender Discrimination, Religion Discrimination, and other various employment-related cases.
Thereafter, Mr. Otkupman started his own firm, which specializes in 1) Employment Law; 2) Real Estate Law; 3) Wage and Hour Law; 4) Bankruptcy; and 5) Taxation Law.
Mr. Otkupman is no stranger to courtroom, having litigated hundreds of cases, both in limited and unlimited jurisdiction, dealing with Individual and Class Action Wage and Hour claims, Disability Discrimination, Whistleblower Claims, Age Discrimination, Race Discrimination, Real Estate Law, Adversary Proceedings in Bankruptcy Court based on non-dischargeability, as well as representing clients in Tax court.
Mr. Otkupman regularly represents third party purchasers at foreclosure sales in all facets of litigation such as Unlawful Detainer actions, filing Relief From Automatic Stay motions, expunging Lis Pendens placed on properties purchased by Mr. Otkupman’s clients, and remanding cases back to State Court after they have been improperly removed. Mr. Otkupman further enjoys writing and has published various articles pertaining to employment law. Specifically, Mr. Otkupman has published an article about the effect of AT&T Mobility, LLC v. Concepcion 131 S. Ct. 1740 (2011) on future class action litigation and the its waiver in arbitration agreements. Mr. Otkupman has further written about the Cat’s Paw theory and the effect of Staub v. Proctor Hospital case on similar Title VII employment litigation. Mr. Otkupman’s latest article focuses on Alternative Dispute Resolution in the Employment arena and explores various types of dispute resolution techniques specifically in discrimination and wage and hour lawsuits.
