OUTCOME: Striking win. Court struck down GPS statute on rare Ex Post Facto grounds.

Mr. Cory was convicted of a sex crime. After he committed his crime, but before his trial, the Massachusetts Legislature passed a law that required every offender who is on probation for that kind off ... ense must wear a GPS bracelet. The question was whether that statute applied to Mr. Cory and others whose crimes were committed before the new law was enacted. The Supreme Judicial Court ruled that it the Ex Post Facto clause of the Constitution was violated by passing this law. The Court struck down the statute as it applies to offenders whose crimes predate the statute. The Ex Post Facto clause is rarely invoked.
