John W. Kim

John W. Kim has more than 15 years of trial experience representing clients and interested parties in large and medium sized bankruptcy matters and commercial litigation in federal, state and bankruptcy courts throughout the country. He advises clients on creditors’ rights and remedies in relation to distressed companies, in and outside the context of bankruptcy proceedings, and in a wide range of sectors including financial services, energy, health care, real estate and utilities. Mr. Kim represents secured and unsecured creditors, creditors’ committees, real estate developers, retail landlords and government agencies.

Mr. Kim negotiates and drafts asset purchase agreements, disclosure statements, and plans of reorganization. He handles bankruptcy adversary proceedings and business litigation involving preferences, fraudulent conveyances, lender liability, non-discharge ability complaints, and enforcement of subordination agreements. Mr. Kim is also experienced representing clients in matters involving construction defect claims and insurance coverage issues. Mr. Kim speaks on various creditor rights topics on national and internationally based legal panels on a yearly basis.
