It seems a long shot and really, what are you suing for? Damages wise there's not much there.

They can try to sue you, yes, but they likely won't win. If they keep contacting you turn it over to your ins. co.

Because he's a minor, the statutes of limitations may be more favorable to him if you need to sue. I would get a lawyer involved immediately.
