Costs aren't fees. Your lawyer is trying to do you a favor by getting these costs waived. I'd cooperate.

That's awful, but assuming you threw it away and moved on with life, the case isn't much more than quote-unquote nuisance value.

Ask your lawyer; the answer is maybe if he/she serves what's called a 998 demand for policy limits timely before trial.
