I would get an attorney, who can help with the lost value of the car and the medical side. Don't do this by yourself, you'll get cheated.

Check with your lawyer regarding your options. When minors get money it is often put into a blocked account.

As others have said, the question is whether this is a known risk of the procedure, i.e. how rare is it and "should it have happened?"
