Our client was charged with a federal offense, Felony Assault Causing Serious Bodily Injury, resulting in a potential sentence of up to ten years. This incident was over a dispute between passengers on ... a flight from LAX to San Francisco. The victim was seated directly behind our client. She reclined her seat before takeoff and ignored our client’s request to place her seat in upright position. The victim again reclined her seat just after takeoff. Our client attempted to start a conservation when an argument began. Our client assaulted the victim. Testimony showed that our client either choked and punched her or simply took hold of her shoulders and shook her. The government presented testimony that the victim suffered a concussion. We called five witnesses: The EMT who assessed the victim on the plane; a passenger, two character witnesses who had known our client, who both testified about his good character, including character traits for non-violence. Client also testified on his own behalf. In the end, the jury acquitted our client of Felony Assault. They found him responsible for simple misdemeanor assault, 18 USC 113(5), a charge carrying a maximum sentence of six months.
