I negotiate all types of deals in the entertainment industry pertaining to film, television, digital distribution of content, literary publications, music, music publishing and more. I also negotiate traditional business agreements (partnerships, joint ventures, etc.), register and advise on copyrights and advise on and prosecute trademark applications.
I began my career as an entertainment litigator at Kulik, Gottesman & Mouton, LLP in 2001 and continued that practice at Lavely & Singer, PC from 2003-2010 where I represented high-profile celebrities in trials, arbitrations, and labor commisisoner hearings. My extensive background in litigating breaches of contract, fraud, unfair business practices, libel, slander, right of publicity and privacy violations, wrongful termination claims and copyright and trademark infringment makes me uniquely qualified to negotiate entertainment and related business transactions. Who better to put the details of a deal together then someone who spent years litigating over deals that fell apart due to poor drafting, vague language, oversights and the like?
PLEASE NOTE THE FOLLOWING ABOUT MY PRACTICE:
I do not shop or seek financing for projects/music/scripts or help find clients representation (agents, managers, etc.). I work for the majority of my clients on an hourly basis. Hourly clients are required to pay a retainer before legal services commence. I do represent some clients on a percentage basis but only if the agreement at issue provides a substantial and guaranteed payment to the client. I do not negotiate option agreements or development agreements on a percentage basis.
Finally, while I'm strictly a transactional attorney, if you have an entertainment or business litigation matter I can refer you to my partner, Paul Berra, who is a very experienced entertainment litigator. Mr. Berra works only on an hourly basis.
