They are pleased to announce a recent recovery of $3 million for one of their clients.
The settlement, reached with the city of Manhattan Beach, relates to an incident that occurred in the summer of 2012. A portion of the settlement will come directly from the city’s treasury while the majority of the settlement will come out of a city risk management policy shared with other Southern California cities, according to a recent article in the Southern California publication the Daily Breeze (“Woman blinded by flying golf disc in park receives $3 million from Manhattan Beach”).
David Lederer negotiated the settlement on behalf of Hermosa Beach resident Noreen Goodbody. Goodbody lost the sight in one of her eyes after being injured at Polliwog Park in nearby Manhattan Beach. The case has been covered heavily in local media including in this 2014 report from CBS News Los Angeles.
In August of 2012, Goodbody was at Polliwog Park attending a practice for her daughter's track team. Practices, birthday parties, picnics and a variety of activities are common at the popular Manhattan Beach park. Another activity that was popular at the time: disc golf. The disc golf course has since been shut down, in part, as a result of the Goodbody incident. According to Lederer, it was only a matter of time before someone suffered a serious injury due to the integration of the disc golf course with the rest of the park.
According to court documents filed by Lederer & Nojima, the disc golf course "traversed through, towards, and nearby areas used by members of the public for purposes other than disc golf." Furthermore, there were few warning signs or other indications of a disc golf course in the park. This is especially troubling since heavy and fast moving metal discs are used to play the game. Players hurl the discs over long distances to get their disc into large metal chain baskets in the fewest amount of throws. Many of these “shots” go off line and are inherently dangerous especially to unsuspecting park visitors. Goodbody was unaware that a disc golf course was present at the park and was horrified when she was struck in the face by one of the heavy discs. Lederer argued that the city put the public at risk by including a disc golf course within the park.
Part of the settlement will be used to repay medical costs Goodbody incurred while trying, unsuccessfully, to have her injured left eye repaired. As a result of the incident, she will likely never see out of that eye again.
Lederer says “fortunately we were able to obtain a fair settlement for Noreen and the city has done the right thing by shutting down the course in the park. Hopefully other municipalities will learn from Manhattan Beach’s experience and prioritize safety before they sanction disc golf or any other dangerous activity at their public parks.”
