Client, 19 year old college student on a road trip from out of state on Spring Break, drives to LAX to pick up a friend flying in. His vehicle is selected for a random search as he enters LAX. A box ... is found in the car containing numerous hallucinogenic mushrooms ("magic mushrooms"). Client admits they are his and that he brought them from his out of state college to consume in Los Angeles while on Spring Break. Client was charged with one count of violating HS 11377(a) - Drug Possession. A conviction would have rendered him ineligible for any federal financial aid, including federal loans. Negotiated a dismissal upon proof of completion of 26 free narcotics anonymous classes.

OUTCOME: Not Guilty Verdict on All Charges at Jury Trial

Client charged with one count of Domestic Violence with Traumatic Injury (PC273.5) and one count of Domestic Battery (PC243(e)(1)). Complaining witness and client dated for over a year, living togethe ... r for six months. During the relationship, complaining witness displayed volatile, violent, and destructive behavior toward client. Client tried to break up with complaining witness, but she would keep showing up unannounced and constantly harassed client with calls and texts. Complaining witness alleged that client pushed her to ground causing injuries to her wrists and legs and that he threw her to the ground and kicked her when she was on the ground on a separate occassion. The prosecution introduced photographic evidence of prior acts of domestic violence and called witness to whom complaining witness had mentioned client's past violent conduct toward her. An expert witness was also called to present her expert opinion regarding Battered Women's Syndrome. After approximately one hour of deliberation, jury returned with a unanimous verdict of NOT GUILTY on all counts.

Suppressio ... n motion asserting violation of client's Fourth Amendment rights was granted. The Judge found that the stop was illegal and excluded all evidence after the stop. Left with no evidence, the prosecutor dismissed the case in its entirety.

Client was in a gas station parking lot waiting for a friend late at night. No driving was observed. Client was approached and arrested without probable cause. I filed a motion challenging the probable cause and the case was dismissed by the prosecutor on the day the motion was to be heard.
