OUTCOME: Case Dismissed in the Interests of Justice

Client charged with violation of Penal Code 148: Resisting, Delaying, or Obstructing an Officer in the Lawful Performance of his Duties. Client was being harassed by a police officer. He was riding ... his bicycle on the sidewalk and told to stop so that the harassing officer could "investigate" the violation. Client kept riding and officer gave chase. Client rode across the street and is alleged to have thrown what looked like narcotics into the bushes (but which were never recovered) until client finally loses traction while fleeing and is apprehended. Client was "known" to harassing officer as a narcotics user, but harassing officer had not been able to catch client. Filed a motion to suppress the fact of arrest for unreasonable search and seizure under the Fourth Amendment of the US Constitution and set case for trial. On the trial and motion date, the prosecutor dismissed the case in the interests of justice based on the motion to suppress that was filed.

Client charged with DUI VC23152(a) and VC23152(b) and Driving without a Valid License VC12500. Client is found sitting in his car in an intersection heavily intoxicated, with numerous empty cans of ... Pabst Blue Ribbon in the car. Fails the Field Sobriety Tests and submits to a chemical breath test with .23/.23 results. Set case for trial. On trial date, negotiated reduced charge of Speed Exhibition VC23109(c) for 18 months summary probation, a $150 fine, attend 26 AA classes and a Mothers Against Drunk Driving Victim Impact Program. DUI and License charges dismissed, saving client from license suspension, increased insurance premiums. Since Speed Exhibition is not a priorable offense, any subsequent DUI conviction would operate as a first conviction, not a second.

Client charged with DUI (VC23152(a) and VC23152(b)) and Driving without a Valid License (VC12500). Client was found sitting in his car in an intersection with the car stalled out, with numerous empty ... cans of Pabst Blue Ribbon in the car. Client blew .23/.23 at the station after arrested, no Field Sobriety Tests were conducted for his safety/inability to complete. Client admitted to having "too much to drink". Set case for trial with a "no driving" defense since no witnesses observed driving and client asserted he began drinking after car broke down. Case settled for a Speed Exhibition (VC23109(c)) with does not count as a DUI for insurance or DMV purposes and cannot be used as a prior conviction if client gets another DUI.

OUTCOME: DUI dismissed, Plea to Driving w/o a License

Client was charged with a DUI with an enhancement for refusing to take a chemical (breath or blood) test and driving without a valid license. Client was observed with poor driving and an unknown drive ... r flagged down the police to alert them to a possible DUI driver. Police observe swerving from lane to lane and pull client over. He wisely refused all Field Sobriety Tests, the Preliminary Alcohol Screening test, and to answer most of their questions. Client did admit to consuming 7 beers that day. Pushed case to trial and the prosecution folded on the day of trial, offering a plea to the driving without a license charge for probation, 6 days beach clean up, and 26 AA's. The DUI was dismissed, saving client thousands of dollars in increased insurance premiums and fines as well as keeping his record clear of any DUI's.

Client is selected for a random vehicle search as he enters LAX. Two baggies of marijuana totalling less than one ounce are found in the passenger compartment and a sword is found in the trunk. Cli ... ent is arrested and items seized. Charged with violation of PC12020(a)(1) - Possession of a Prohibited Weapon and HS 11357(b) - Possession of Less than 28.5 grams of Marijuana. Presented valid Medical Marijuana License and got marijuana charge dismissed. Convinced prosecutor that sword was decorative and did not fall within the definition of a prohibited weapon according to the law. All counts were dismissed and the judge signed an order for return of client's property.

Client accused of Domestic Violence with traumatic injury (PC273.5). Complaining Witness alleged client and her got in an argument while driving home from dinner and drinks and client started hitting ... her in the face, causing swelling to the forehead area. Complaining witness did not show for trial but prosecutor proceeded with trial. Presented evidence from the officer who interviewed complaining and witness and took pictures of her. Pictures and 911 recording were introduced. Defense presented alibi witness establishing that client was with alibi witness on the night of incident and dropped him off at his home. Jury deliberated less than 2 hours before coming back deadlocked 10-2 for acquittal. Mistrial declared and defense motion to dismiss granted.
