Plaintiff was a laborer for a fish company at the New Fulton Fish Market. He was operating a pallet jack in a loading area when a forklift operator struck him, severely injuring plaintiff's leg. The owner of the forklift agreed to offer their entire insurance policy of 1 million dollars, but the market denied that its unsafe practices contributed to the accident and refused to offer additional money.
