The Certifiying Officer with the DOL denied our H-2B application based on an incorrect finding of that our client was subject to an H-2A Visa. After appealing to BACLA, the administrative judge, decid ... ed in OUR FAVOR and agreed that "fencing and construction laborers" working incidentally at a Ranch does NOT subject them to be classified as agricultral employees and requiring H-2A Visas.
