At age 4 months, the infant-plaintiff was admitted to SUNY Downstate Medical Center for heart surgery. Post-operatively, in the pediatric ICU while still intubated, she developed a mucous plug that ob ... structed her airway. We were able to show that the doctors and nurses caring for the child in the ICU failed to properly suction her breathing tube and failed to timely diagnose the mucous plug. Unfortunately, by the time the diagnosis was belatedly made, the child had been without oxygen for a significant period of time and suffered profound brain damage.

A 57 year old husband and father was admitted to SUNY Downstate Medical Center for Coronary Artery Bypass Graft surgery (CABG). The Perfusionist operating the Cardio-Pulmonary Bypass machine failed to ... purge the air in the tubes of he bypass machine and the heart surgeon failed to check that all air had been purged. As a result, when the machine was turned on and the patient placed on bypass, air was injected directly into his aorta, traveled to his brain, caused a stroke and ultimately the patient died from his injuries. We represented the patient's surviving wife and son in a wrongful death action.

The patient was admitted to New York Hospital for replacement of her Aortic heart valve. After excising the patient's Aortic valve, the surgeon failed to properly select the correct size prosthetic re ... placement valve. The valve he selected was too large for the patient's Aortic annulus and did not seat properly, obstructing the patient's Left Main Coronary Artery. Post-operatively, the surgeon failed to diagnose the improperly seated prosthetic valve, which led to the patient's complete cardiac arrest. Ultimately, the patient was required to undergo a heart transplant. The surgeon denied any responsibility for the patient's injuries, but we were able to arrange for the surgical team from Utah who performed the patient's heart transplant to fly to New York and testify that the implantation surgery was performed improperly. After this testimony, the case settled.
