We were discharged from ch 13 (indiana) Jan '11. Can we walk from mortgage? we stayed in home, kept up payments.

Usually the answer is yes the obligation is discharged and the bank gets the property back. Talk to your lawyer.

I cant pay 1300 in fees for a misdemeanor case. I found fee waiver form for misc. fees but not for criminal cases.

If the $1300 is a fee you owe to an attorney then it is dischargeable, list it on schedule F. If it is restitution than it is non dischargeable but...

I do not see a reason for either your attorney or the trustee to notify your dad. I think you can accomplish this goal.
