They must be included in your bankruptcy. So long as she pays these debts her credit won't be damaged by your bankruptcy.

If you are legally liable to pay the debt then why wouldn't you? Now you might be on the hook for opposing parties attorney fees too.

You may be able to convert to chapter 7 depending upon certain variables like you income, potential hardship issues and others. You need a lawyer.
