Situation involved a stolen credit card disguised as a gift card. The saying if it is too good to be true it probably is applied. When it was explained there was no intent to steal anything and it wa ... s a mistake of looking the other way when the person should have know the card was stolen, the charge was reduced to an undesignated offense which automatically reduced to a misdemeanor upon termination of probation.

The officer on several of my cases did not show on the scheduled trial date, but the court continued the trials for several weeks, instead of dismissing them, because the officer requested it. I objec ... ted and thereafter gave written notice to the court and city attorney that I was demanding a speedy trial. On the new trial date, after reading the City Attorney's response, the judge requested further briefing on the relevant case law and statutes. Finally, after reading my supplemental brief on the issue, the judge agreed that the right to a speedy trial was violated and dismissed the cases.
