My fiancé and I are both homeowner in the same community, however my fiancé is a paraplegic and requires wheelchair accessible. I had recently identified multiple ADA violations found at Kimberley Park, our community park to Kevin Bald, the CCMC Manager when I received a email from Josh Bolen threate...ning me with a fraudulent Ceased and Desist Letter that threatens legal actions if I further communicate with Kevin Bald. Josh Bolen’s letter cited an erroneous case law to scare me away from reporting these violations. Josh Bolen has failed to protect the rights of people with disabilities throughout the Garden Lakes Community. These violations have been reported, identified and agreed upon by the City of Avondale, however Josh’s lack of due diligence of the law is leaving my community open to a Civil Rights lawsuit. Josh Bolen must not know, understand or respect The American with Disabilities Act or the 2010 Stand of Design for Accessibly. Instead, Josh Bolen has made a conscious decision to cover up these ADA violations without even understanding what the true violations are. No lawyer should ever try to intimidate an everyday citizens from correcting these violations lake Josh Bolen has done.
