Patrick Nackley

I am Patrick T. Nackley, founder and managing attorney of Nackley Law PLLC in Scottsdale, Arizona. My practice specialty is Arizona real estate with a focus on litigation. I represent homeowners, property owners, investors, real estate agents and brokers, contractors, and closely held businesses in contested real property disputes in the Arizona superior courts and in the United States District Court for the District of Arizona.

The matters I handle are specific: HOA and CC&R disputes, including fines, architectural denials, selective enforcement, and special assessments; Easement, boundary, and trespass disputes between neighbors; Quiet title actions; Construction and contractor disputes, including Purchaser Dwelling Act claims; contractor license bond and Recovery Fund claims, as well as mechanics liens; Seller misrepresentation and nondisclosure claims after a purchase; Real estate commission and procuring cause disputes between agents and brokers; and breach of real estate contract cases, including seller misrepresentation and escrow deposit dispute.  I also handle commercial litigation and business disputes. I do not handle residential closings or evictions.

I have practiced law since 2002. Before founding Nackley Law in June 2026, I served as a partner at a Scottsdale litigation firm, where I was first chair trial counsel in real estate jury trials, as senior counsel to a private land investment company with holdings in fourteen states, as senior counsel at a Phoenix real estate litigation firm, and for sixteen years as in house corporate counsel. That mix of experience allows me to evaluate a real estate problem from the perspective of the courtroom as well as from the business side, at the same time.

I am admitted in Arizona (2005) and Colorado (2002, inactive) and before the United States Courts of Appeals for the Ninth and Tenth Circuits. I hold a J.D. from the University of Denver Sturm College of Law, an M.A. from the University of Tennessee, and a B.S. from Virginia Commonwealth University. I am a member of the State Bar of Arizona Real Property Section. I write about Arizona real estate disputes on the Insights page of the Nackley Law website and was a guest on the Phoenix Prosperity Podcast in October 2026 on solving real estate legal problems in Arizona.
