Connaught Tower, dismissed the shareholder’s complaint and remanded the case for a hear ... ing to determine the cooperative’s reasonable attorneys’ fees. The trial court had originally held that second hand smoke infiltrating into a cooperative apartment caused the Shareholder to be constructively evicted and be relieved of all obligation to pay maintenance.
