M. Sean Breen

Sean Breen grew up in Idaho and is a graduate of both Idaho State University and the University of Idaho. Sean is retired from the United States Army having served our country for over 23 years. Sean is an experienced trial attorney who began his practice in 1994 after clerking at the U.S. Department of Justice, Minnesota Attorney General’s Office and the U.S. Department of Energy.

Sean now primarily practices in domestic relations (or family law) but also handles general legal matters (e.g. contracts, non-compete agreements, business formation, landlord tenant, probate, employment, personal injury, workers comp, etc.). Sean has litigated hundreds of civil trials in southern Idaho involving a number of different legal matters.

Sean and his wife, Lora (who is also a senior Army officer and an attorney) helped co-found Anser Charter School; Idaho’s first service-oriented and community-based K-8 public charter school. They spent several years helping the school plan and organize the purchase and remodel of the school’s current facilities. Sean also participates in numerous other service-oriented activities including the Idaho Academy of Leadership for Lawyers (IALL), Recreation Unlimited (Bogus Basin’s adaptive ski program), and Boise’s downtown YMCA. He also volunteers his time through coaching soccer, baseball, tennis and other youth sports programs. Sean spends many summer afternoons rafting Idaho’s wild and scenic rivers in the summer and skiing Idaho’s mountains in the winter.

PRESENT PRACTICE:
Representation largely focuses on domestic relations and family law matters (e.g. divorce, child custody, support, adoption, guardianship). Also conducts legal reviews and litigates the validity non-competition agreements, represents injured workers and other persons injured by the negligence of others.

REPORTED CASES: Frieburger vs. JUB Engineers, Inc. 141 Idaho 415 (2005). This Idaho Supreme Court case establishes the legal precedent under which non-compete agreements are analyzed under Idaho law.

Child support
Sean is professional and knowledgeable in regards to child support and the rights of the parent. He is ready and willing to fight for what you want in court. He will listen advise you if he believes anything is not in your best interest.

Custody case
Sean Breen’s helped me get sole legal and physical custody of my baby boy. The process was so fast and painless. I was very nervous, his confidence and knowledge reassured me and kept me feeling confident as well. He was very passionate about what he was doing and communicated with me about every possible scenario and step we would be taking. I am beyond please with the work he has done for me and my family . After we had won the court hearing he also helped me write out my final will and testimony , he’s phenomenal at what he does all around.

Saved my family
Working with Mr. Breen was my first experience needing a lawyer. I was referred to his firm and 2 others. He was the first to call me back, within an hour of my initial message. He explained the process thoroughly and quickly. He didn’t sugarcoat anything and was very up front about the amount of money I might spend as well as what my expectations should be for the hearing I was summoned to. He had a little over 24 hours to prepare from my initial call. He was kind and thorough, his questions during the hearing were thoughtful and prepared and his years of experience was obvious. I would recommend him and will use him again if the need arises.

Excellent attorney for divorce and custody cases
I hired Mr Breen's firm in custody case. In that high stress time Sean Breen and his team were amazingly responsive, supportive and empathetic. Mr Breen is tough negotiator and interrogator, he was prepared and relentless at deposition. The first call you need to make.
Mr. Breen and his team are the superior law firm in the Treasure Valley. I contacted multiple law firms before choosing Mr. Breen for his wealth of knowledge in the field of law and his immpecable counsel. Mr. Breen started by walking me through all different scenarios, creating a plan of action, and getting short and long term goals made. He guided me through the sizable decisions needing to be made with the upmost care and benevolence. Peace of Mind
I dropped a previous attorney and hired Sean Breen to handle my custody battle. Needless to say, I made the best investment of my life. Sean is intelligent, enthusiastic, and puts you at ease through a stressful time. He is like a bulldog. Meaning, he will fight for you in an intense , but strategic way. His military persona coupled with his expertise in law is a phenomenal thing to witness. I highly recommend Sean. He saves you money by letting junior attorneys within the law firm handle the paperwork side of things. Prepare yourself though, because you will recieve a copy of absolutely everything they do in the mail within days. Sean and his staff are a pleasure to work with. I simply couldn't put into words how confident he has made me feel through this difficult time.

Satisfied and Grateful Client
I have met Sean Breen several years ago for a brief consultation in highly contentious and protracted custody battle. Sean quickly grasped complexity of the case and mapped several paths and scenarios to resolve the situation. Sean was the fourth attorney on the same case I am fighting for several years. He immediately stood out among many attorneys I had known professionally both as a client and an employee. I knew he would be the best and the last one. My immediate instinct was only confirmed later by the facts where his professional expertise, fast and piercing mind were matched with extraordinary generosity, caring, integrity and straightforward honesty so rare in his profession. Most people would appreciate that speaking publicly about such painful and private issues as divorce and custody is difficult. And so I will not dwell any further on my case but rather will let you know what one can reasonably expect to find in Sean’s Breen’s law practice. Sean has a military sense of strategy, a brilliant extremely quick mind, gut feeling of human psychology (may be he is trained in it?), and a great unmistakably Irish sense of humor that he calls to the rescue here and now to diffuse high stress situations. I feel that I did not only hire an exceptional and competent attorney to fight for my child by also gained a much needed loyal friend to the process. Often I feel bad about eating into his personal time and his exceptional generosity, but Sean keeps on assuring me that it is okay and that is what he and his family do. We had used Sean for several years and trusted his guidance until recently. We recently had our trial and before, during, and even after he was more concerned about how the judge portrayed him and not making the other party (who was pro se) look like we were picking on her even though we had provided all the proof necessary to prove that she was a continued drug addict and criminal. After receiving the answer from the judge we met and discussed what we were going to do moving forward. It was at this time we were basically lied to - we were told to put together a list of what we would like to see/added to the new and from the old agreement from what the judge had ruled on. We had also discussed continuing the case for another issue and were told to work with his associate and to bring down the information when we were able to. We brought down the paperwork a week after the judge's decision and while we were down there we asked his associate if she had an update on our case because, we were told the week before that we would have a draft sent to us on Friday to review. She took our paperwork and said she would find out and get back to us. The following day we get a hostile email from Sean telling us that asking about the order and the due date is pissing him off and how he didn't appreciate us showing up to his office unannounced because he meets his deadlines. Well no unfortunately the deadline was not met and when we received the draft there were several items that were incorrect and needed to be corrected. We were told that the information was listened to several times but when we listened to it the first time we heard very clearly what the judge actually ordered. We were then charged for the time the draft order was created to include the hours where we emailed back and forth regarding the inaccuracies based off the judges comments. After several email conversations going back and forth we thought a phone call was more appropriate however, this turned into a pissing match that got each of us more angrier than before. We would not have been so upset if we were not told one thing after the judge's decision and then something completely different when being drafted and then having to pay for Sean's errors on the draft order and it then having to be redone at least three timess due to the continued inaccuracies. It felt like at one point that he leaned more towards the other parties side instead of our interest. Over the years we have paid over 20k to Sean and to have it end like it did is very disappointing. All we needed was better communication and a chance for us to actually be heard instead of being shut down. I know Sean is a good lawyer however, I believe that Sean carries a much too heavy caseload and should actually take a look at decreasing that workload so that he can spend more time on cases and maybe help with not getting cases confused or saying something that actually cannot happen. We know another couple that is currently using Sean and they are having very similar issues. So I truly believe that decreasing his workload could help bring him back to the caring even-keeled lawyer he was when we first hired him 5 years ago. I will give his support staff 5 stars as they do work hard and are amazing and easy to work with.

Poor Representation
I hired Sean for a divorce. He called back quickly and we discussed an overview of the process at initial meeting. But he never followed what he explained and my results were poor. Their billing was for significantly more than what he accomplished. I had to hire a different attorney.

Incompetent and zero empathy
I hired Sean as my divorce attorney and dealing with him was the worst experience of my life! Over two years of dragging my case on he told me he had no idea what the judge meant in my divorce settlement. Sean exhibited a huge lack of empathy as well as displaying no moral fiber during my divorce. Total waste of my time and resources. I would definitely think twice before hiring this horrifically bad attorney that only has his best interest in mind.

Average lawyer with a terrible team
Sean was very responsive initially but after the first few weeks, he began to be slow to respond to emails and calls -- sometimes never responding at all to the concerns of the case. On the positive side, he speaks well and confidently and appears to have good grasp of the law. If Sean had been more responsive and spent more time working on my case himself, I may have had a different experience. Instead, Sean relied on a very poor team. Sean's team of recommended consultants were awful. The consultants were unprofessional, they missed meetings, lost emails, and showed general confusion around basic subject matter principles. One example of the unprofessional behavior occurred when the defendant and plaintiff (divorce case) were both lectured by a consultant about how much God hates divorce, as well as other inappropriate comments concerning his own personal religious beliefs.
