Before you pay do your research!

My family hired a Spokane attorney, Kevin Roberts, a partner with Roberts Freebourn PLLC, to represent us on two malpractice cases in Idaho against our prior attorneys, Susan P. Weeks (Coeur d’Alene) and Steven P. Wieland (Boise). Both attorneys had failed to procure expert witnesses on our behalf... for TRIAL, which was detrimental to winning our case. Kevin Roberts never informed us that a conflict of interest existed between him and our prior attorney Steve Wieland, where both attorneys were heavily litigating against each other in another case concurrently running alongside our malpractice cases. Kevin began demanding that we settle with Steve Wieland prior to Trial even though we had a decent chance of winning our malpractice suit against Wieland. We ended up losing our chance to win the malpractice cases against both Weeks and Wieland because Kevin Roberts had missed the pretrial DEADLINE to timely hire our expert witness, which was also detrimental to winning our malpractice cases. We soon discovered that the expert witness Kevin had eventually hired, attorney Merlyn Clark, with Hawley Troxell, was hired after the Court Ordered pretrial deadline had passed. Merlyn Clark had been practicing law for over 50 years in Idaho and was well aware of pretrial deadlines, yet he too also ignored the late disclosure and continued to review our documents that Kevin had sent to him, accruing an unbelievable $52,000.00 expected pay-out!!! Kevin Roberts should have never hired Merlyn Clark for multiple reasons, especially since Kevin missed the deadline to do so. Merlyn Clark should have never accepted Kevin’s invitation to be an expert witness! On May 25, 2023, the Court dismissed our malpractice case with prejudice due to the fact that Kevin Roberts missed the pre-trial deadline to disclose an expert witness to testify on our behalf. The judge did not allow Merlyn Clark to testify as our expert witness. On August 8, 2024, over a year after the case ended, Kevin Roberts demanded that we pay for Merlyn Clarks alleged fees totaling over $50,000.00, as Merlyn Clark was suing Kevin Roberts for said fees. On April 2, 2025, Kevin Roberts, under the name of Roberts Freebourn PLLC, then filed a Complaint against us demanding we pay over $50,000.00+ to him for the Merlyn Clark alleged debt. Merlyn Clark aka Hawley Troxell should have never agreed to Kevin Roberts request to be an expert witness and then attempt to collect over $50,000.00 for doing absolutely nothing!
