Victory in Immigration Court on Application for Cancellation of Removal of nonpermanent resident

OUTCOME: Client granted legal permanent resident status

Case involved 33 year old native of Mexico living undocumented in the United States since approximately 1999. Client had a US Citizen spouse and two US Citizen children. This case was a significant ... victory because we had to overcome the high level of hardship known as exceptional and extremely unusual hardship and because in 2000 client was apprehended by Immigration Authorities and returned to Mexico. Attorneys for the government argued that client was ineligible for relief because of this return and that pursuant to case law client was disqualified. Attorney Barrera went further researching case law indicating that an individual is disqualified only if he understood that he was waiving his right to see a judge when accepting a voluntary return. Attorney Barrera prepared client explaining the details of his apprehension and the fact that he did not understand he was waiving his right to see a Judge in 2000. Furthermore, Mr. Barrera prepared documentation and client's wife to testify appropriately about her suffering if client were removed resulting in the Judge being convinced that client deserved discretion and granting his application. Client now lives in the United States as a legal permanent resident and in less than five years will qualify for US Citizenship.

At the end of the hearing the Judge decided that the client and her children met the high level of hardship and granted the client's application. Another client living legally now in the United States with her Green Card awaiting to become eligible for Citizenship in less than five years.
