Not What He Says

Dissapointed in his representation

I hired Mark Anthony Barrionuevo for a D&N case that was scheduled for trial to get false allegations dismissed. First thing he did was rescheduled the trial out past my child's 18th birthday leaving my case with no leverage, and leaving me not being able to vindicate myself. All he had to say was "w...hoops". I was shocked he made such a careless decision without speaking to me first. I told him to consult with me before making other decisions on my behalf. Next was a meeting where I was fighting to see my child. At that meeting Mark Anthony pulled me outside the meeting room and asked me to offer goodwill to the other side and give them 100% custody of my child, to the very people who pressed false allegations against me. What??!! I said absolutely not! Back in the meeting, instead of advocating visits for me, he told the other side that he honored their feelings and said he wouldn't request visits again. He totally relinquished my visits without ever asking me! I wondered if he was colluding with the other side because he wasn't looking out for my best interest. While on vacation , there wasn't anyone to respond to some matters while he was gone. It seemed like he was giving up my rights at every turn, to negotiate with the other side. He told me he had the right to make decisions on my behalf and if I didn’t' like it, he'd withdraw. There were times he spoke to me with a bullying tone and with arrogance. I asked him to get discovery that wasn't being provided to me and he didn't do it. He tried to get the discovery at the last minute and wasn't able to obtain it. At the end of my case, he didn't pick up the exhibit..said I didn’t need it even though he knew that another attorney would need it. He didn't know about some of the statutes etc and it was evident he never took the time to research them, so I had to explain them to him. Then he used the information I gave him to respond to the other side. He then turned around and charged me for the emails where I had to explain the law or child's rights to him. He's the only attorney I know of that charges his hourly rate for travel to the courthouse, not sure where he travels from, but travel charges are significant. He wasn't at the El Paso County courthouse much, was more in Denver. At first he was considerate of my retainer, but towards the end he begin nickel and diming quite heavily making huge bills. I'm inclined to think that he took my case more for the money instead of wanting to earnestly advocate for me.

This is a sad situation. All of these allegations are not true. I could rebut each falsehood but this forum is not the appropriate place. I have reached out to this client offline to resolve their concerns and see if there is anything I can do to discuss all perceptions of what occurred but to no avail. Suffice it to say, I helped this client have their case dismissed, and after ignoring my bills for weeks, this is the payment I received from this client. I care deeply about my clients and do all that is legal, moral and ethical for them. I think my record and other reviews show that. I am sad and hurt that this client has acted in this manner. Unfortunately, their challenges go far beyond the scope of this case. I pray they receive the help they need.
