I don’t know who wrote this review. I am known for initiating early negotiations to try to settle cases or limit issues in order to save attorney fees. While not every case can be successfully resolved through negotiations, the vast majority of our cases are. I would not have “insisted” that any case “go to trial.” If the parties are not able to reach settlement, the Court requires that the legal action be resolved by a trial. The decision to settle or try the case is often driven by facts not disclosed or known at the time the dissolution action is initiated. The decision also depends upon the reasonableness of the position taken by the parties. It is difficult for some litigants to accept that their version of what is fair, when all facts are on the table, may not be shared by the other party or the Court. Courts have wide discretion in determining what is fair and if a settlement offer from the other party avoids a possible worse result from trial, settlement must be seriously considered. However, the decision to settle or try the case is entirely up to the client.
