Lack of experience
Mr. Peterson was hired to handle a complicated custody case, to where the mother could not be located in another state. He was hired in good faith that he could handle the case that needed to be handled. I can remember the day in court, like it was yesterday. I was forced to pay one of his colleagues...
"George" 's statements are untrue and he failed to follow my advise. The Texas Rules of Civil Procedure require that when a person is notified of a law suit by publication in a newspaper (as in this case), an attorney ad litum must be appointed to represent the absent party. That is why "George" had to pay another attorney besides me. I would explain how "George" failed to follow my advise and why he is the cause of his own problems, but he has not given me permission to share these facts and it would violate my sense of ethics and the State Bar Rules to do so without his permission. In 30 years of practicing law I have never been found to violate the Rules of Professional Conduct.
