Do not trust this attorney

I am leaving this review based on my family's experience with David Silberthau in my husband's criminal case. Before Mr. Silberthau became involved, my husbands prior attorney had told him that there were serious concerns that the State had violated his constitutional rights. When Mr. Silberthau was... appointed, we expected those issues to be investigated and protected. From our experience, that did not happen. We did not see Mr. Silberthau adequately pursue the alleged constitutional violations or fully investigate the evidence and circumstances that we believed supported his innocence. We were particularly concerned that there was no evidence presented to us that established that my husband had committed what he was accused of doing, yet those concerns did not appear to receive the attention we believed they deserved. My husband ultimately entered a 35-year plea agreement on July 23, 2026. From my perspective as his wife, Mr. Silberthau's actions did not feel like advocacy for my husbands interests. Instead, I felt that the process ultimately benefited the State in obtaining a conviction rather than adequately protecting my husbands rights and investigating the issues surrounding his case. Mr. Silberthau later sought to withdraw from representing my husband on the appeal, and new counsel was appointed. This review reflects my personal experience and perspective as my husbands wife. I believe anyone considering legal representation should ask detailed questions about how constitutional issues, evidence, plea negotiations, and appellate rights will be investigated and protected. I felt that Mr. Silberthau acted more like an extension of the prosecution's position than an advocate who was fighting for my husband's interests
