Scott Kevin Boates

Me and my mentally handicapped daughter were poorly represented by attorney Scott K. Boates. He offered to represent us against Memorial Herman Hospital after my daughter was brutally attacked and falsely imprisoned by Hospital staff. He promised to get assistance from an attorney or attorneys with ...more experience in such cases. He furnished a contract which we signed that required him to get such assistance. The State Bar rules require him to get assistance under these circumstances. In spite of my many requests he neglected to get help. I paid him $750.00. He was to take 40% of any recovery. A lawsuit was eventually filed but dismissed after discovery started when he neglected to file an expert report. Had he obtained help as required the expert report would have been filed. Boates appealed up to the Texas Supreme Court. All appeals were denied. A judgment was issued against me personally for more than $27,000.00 to reimburse defense attorney fees. Boates recently filed a motion for a new trial. At the same time he advised me that he was withdrawing from the case. He will not appear for the hearing he requested nor will he take part in a new trial. Had the case not been dismissed winning would have been a slam dunk. There is no chance for getting a new trial. Boates has not notified the court of his withdrawal. Other attorneys have advised me that Boates’ failure to file an expert opinion is legal misconduct. An appeal could possibly be made about the judgment against me. There is no justice in requiring me to pay for the misdeed of Boates.

She had adequate income to live in her own home and sleep in her own bedroom. Even though the horrible disease took over her mind , her dignity and privacy and personal care were my upmost concerns. Thanks to Scott I was able to take my mother out of the nursing home, which horrified her, and bring her home for her remaining days. I cannot empathize enough the emotional state of mind I was in. Scott Boates literally took me by the hand and took over. He accessed all angles of the case. Scott Boates is a calm man with a big stick and stays knowledgeable with new trends. To say he is exceptional doesn't quite make it. To me he was more than that. He truly got into the challenge with his heart and soul. He cared and empathized with the situation by taking action, not just words and a bill. We were able to settle through mediation. It turned out unbelievably favorable. Scott Boates has an uncanny way of communicating and is able to turn tables in a blink of an eye. This was a life changing experience for me after losing my mother. I do not know how I would have gotten through it all without his knowledge and strength and empathy. He made the whole stressful legal time table as painless as possible. Scott communicated with me and handled issues like a dear trusted friend would. Needless to say, I feel very confident in recommending Scott Boates, especially for complicated deep cases. Scott defended a lawsuit claiming that I was negligent in lending an automobile. But I did not own the automobile. Not only did Scott help me get out of the lawsuit, at trial the plaintiff was only awarded $14,000.00 from the other defendant. The plaintiff wanted almost $150,000.00.
