It sounds like you are subject to the 3 year bar. You overstayed in the US for more than 180 days and are therefore subject to a 3 year bar....

If your friend came June 23rd of this year they would not qualify. If it was July of 2012, then yes he would qualify.

Unfortunately, VAWA Violence Against Women's Act only applies to spouses of US citizens and green card holders. She should seek a shelter.
