This is exactly why there is renters insurance. Most apartment leases have a clause in them that they are not responsible for this damage

You would have to be able to prove that this is the only reason your home got termites, Might be hard to prove

Yes-you can sue if in fact you can prove that this is the reason you are having this problem. You might want to have an engineer check this for you
