Probate is the process by which property is transferred at a person's death. It involves presenting Wills to the court to be admitted to probate, representing and guiding executors, and representing the heirs of a person who died without a will.

Estate planning has two parts: planning to transfer property and care for your children when you die and planning for your own care in the event you become disabled. We do this with Wills, Trusts, Powers of Attorney, Living Wills and other documents

My practice mostly involves assisting the parents of special needs children obtain guardianship over their child when he or she turns 18. Many times there are alternatives to guardianship which can avoid the expense and complexity of the process.

Trusts can be used to avoid probate at the time of your death. Special needs trusts help provide for children with special needs qualify for public benefits but still have additional resources for their care.
