When someone dies, that person leaves behind an estate that consists of assets and debts that may need to be processed through an administration of that estate. A family member or loved one can request to be appointed to handle the administration of the decedent's estate. It is very important to consult with a probate attorney to discuss whether an administration is necessary, and the possible alternatives to probate.

We recommend that an estate plan start with four basic documents: (1) Last Will and Testament, (2) Legal Power of Attorney, (3) Medical Power of Attorney, and (4) Directive to Physicians (aka "Living Will"). In addition to these four basic documents, you may need additional documents to cover your estate planning needs (ie. Trust, Declaration of Guardian for Minor Children.)
