If a court rule mentions whether a particular argument has been heard, but it's in abeyance, is it construed to have been heard?

I think that the answer to your question is "no", but like I wrote on the other answer, go see an attorney and get a solid answer to your question.

Check your state rules. Every HOA, even a small one, needs to have a relationship with an attorney to keep you out of trouble. Worth the cost.
