Great Lawyer

Very Impressed. Hired to review some contracts (oil & gas leases), prepare a power of attorney for my mom. Later on, he did my divorce. Very knowledgeable, accessible...returned my calls, answered my questions. He got me primary custody of my kids, what I really wanted, and got the Judge to order... my ex to pay child support based on what he actually made, rather than what he said he made. He and his staff found the evidence to do it. All in all, helped put me in a much better place.

Made up dates and fees in order to retain my money.

I signed a contract, paid a retainer fee all in good faith. Mr. Smith prepared and sent a certified letter for me while I sat in his office. Eight days after the date my letter was sent, I called his office to see if there had been a response to the letter. I was informed there had not been and wa...s assured the attorney would contact me as soon as he heard anything. 4 months later after hearing nothing from anyone, I sent a certified letter to my attorney requesting an accounting of charges and a refund of my retainer fee paid. After two demand letters and phone calls and almost a month and a half later I did receive a refund check with a statement of fees and costs. There was almost $500.00 of fees listed for events that never took place and things stated that I did when I could not have done them, as rejecting a settlement. I was never told of a "negotiated settlement" therefore I could not have rejected said settlement. Dates that indicated the opposing council had a conversation 4 days after my certified letter went out when I had called 8 days after the letter went out and was told there had been no correspondence from the other side. Dates that said I spoke with my attorney that did not happen. I never spoke or heard from him again until I called his office for a second time to find out when I could expect my refund and he happened to answer my incoming call in lieu of his office staff answering the phone. The time frame went from 8/4/16 to 12/26/16 where there was no communication what so ever. He answered the phone call I made on 12/27/16 which was the first time I had spoken to him since walking out of his office on 8/4/16. I am in the process of trying to get the rest of my money refunded. I sent another letter via fax to his office today, called and left a message and no one returned my message or my request to acknowledge receipt of my faxed letter. Based on my history with this person I do not hold out much hope for the rest of my money to be returned to me. Very disappointed with my experience. Do not know if I have any recourse or possible way of getting back my money that was wrongfully retained.

I have tried my dead-level best to work this dispute out with this former client, and have determined that she is simply dissatisfied and doesn't believe she should pay any fees for the work expended on her account. She was refunded her unused retainer several weeks ago. As far as I can tell, she simply wants to complain. She denies phone calls and conversations in spite of an itemized bill stating the exact time expended on her case.
