My client was charged with 3 counts of First Degree Criminal Sexual Conduct (forceable rape), Kidnapping and Unarmed Robbery. The allegation came from a woman who was at a seedy downtown Detroit hotel ... where people party on New Year's Eve with her boyfriend. She left the room "to get ice" and bumped into some guys she knew and had sex with them in an alcove of the hotel. Her boyfriend went looking for her when she was gone longer than expected and he caught her with her pants down (literally). The guys had already left. She told her boyfriend she had been raped. She never picked anyone out of a line-up but 3 years later, my client's DNA was a possible match to DNA found on her underwear. I pointed out the uncertainty of the DNA and the fact that the DNA was only on the underwear and not on or in her body according to the Rape Kit. She never identified my client although she was shown photo line-ups including his picture and a live line-up after he was arrested. There were other problems with the people's case, including surveillance video of the alleged victim speaking with and traveling up and down the stairs with few different at around the time she claimed to have been raped, suggesting that she indeed knew the men she had sex with.
