OUTCOME: Appellate court victory for client
The Texarkana Court of Appeals considered Mr. Ray's argument for a drastic expansion of fiduciary duty in mineral rights cases. Mr. Ray argued that the Plaintiff, the owner of a non-possessory rights ... interest, was owed a fiduciary duty by the executive rights owner that was greater than that previously stated in the law. Mr. Ray also presented an argument that equity should guide the court's decisions in an area where equity had never been previously considered. The Texarkana Court of Appeals unanimously agreed with Mr. Ray, and issued an important opinion in August 2012. This opinion has been cited as precedent in briefings since that time, and referenced in oil and gas legal articles. The Supreme Court later found that there was no reversible error, and remanded the case for a trial on the merits.
