If you are in the US then you went out of status. If you are out of the US you did not have any status to lose.

Yes you can do that with a new I-20 but note that after graduation you will not get OPT since it is the same degree level.

You really need to consult with a Board Certified Immigration Attorney since hardship 212(e) waivers are almost impossible to obtain.
